GENERAL TERMS AND CONDITIONS

of VICE SPORTING GOODS GmbH

These are the general terms and conditions of Vice Sporting Goods GmbH (hereinafter referred to as "Vice Golf"). All our deliveries and services are carried out exclusively on the basis of these GTC.

Explicitly excluded from this are deliveries and services of Vice Sporting Goods, Inc. with scope in the USA and Canada.

§ 1 Scope

All deliveries, services and offers from Vice Golf are exclusively based on these terms and conditions unless the parties explicitly agree otherwise. The version valid at the time of the conclusion of the contract shall apply.

§ 2 Conclusion of Contract

The goods and services presented on the internet, in brochures and advertisements do not represent a legally binding offer from Vice Golf. They are an invitation to the customer to make a binding offer to Vice Golf.

The customer can place orders with Vice Golf via the online shop (www.vicegolf.com) by clicking the "Buy" button in the final step of the checkout process, by phone, or by fax. In the online shop, a confirmation window with the order details is displayed before the order is finalized. By ordering the desired goods, the customer submits a binding offer to conclude a purchase contract. Vice Golf will confirm receipt of the order in text form. This confirmation does not constitute a binding acceptance of the order. The purchase contract is only concluded when Vice Golf explicitly confirms the order or dispatches the ordered goods to the customer.

Vice Golf reserves the right to reject customer orders in individual cases. Orders may be rejected in particular if they deviate from the requirements specified by Vice Golf, the customer is assessed as not creditworthy, billing information cannot be verified, delivery cannot be made to the provided address, the desired product is not in stock, or the stated price was incorrect.

§ 3 Copyrights

Vice Golf is not the copyright holder of logos and images displayed on its website as customer and print examples. The copyright holder is instead a partner of Vice Golf, a customer, or another third party who provided the images and granted Vice Golf unrestricted usage rights to them. The respective partner has also assured Vice Golf that the described use of the images does not infringe any copyrights, other protective rights, or rights of third parties.

The sold products may only be used by the customer for private purposes, indefinitely and worldwide. Commercial resale, reproduction, distribution, public accessibility, modification, and editing of the products are strictly prohibited.

§ 4 Customer Obligations

The processing of submitted data and image products by the customer takes place within a technically automated process without manual review and correction by Vice Golf. By uploading files, the customer confirms that they have the right to distribute and reproduce the contents and materials of the file.

The customer guarantees that the contents and materials of a submitted file do not violate applicable laws. In particular, the customer guarantees:

  • That no illegal, violent, inciting, racist templates, materials, or content, propaganda tools, symbols of unconstitutional parties or their substitute organizations, instructions for criminal acts, pornographic materials, or content relating to child sexual abuse or sexual acts with animals, or any discriminatory statements or representations regarding race, gender, religion, nationality, disability, sexual orientation, or age will be submitted to Vice Golf;

  • That no laws protecting minors or criminal laws will be violated, especially regarding the legal regulations of §§ 184 ff. StGB (distribution of pornography), §§ 185 ff. StGB (insult, defamation), and the provisions of the Interstate Treaty on the Protection of Minors in the Media;

  • That the templates (especially image and text files), content, and materials submitted to Vice Golf do not violate copyrights, trademark rights, or other protective rights of third parties, personal rights, or other third-party rights.

§ 5 Delivery

Delivery is made from the warehouse of Vice Golf unless otherwise agreed in writing.

Vice Golf endeavors to meet the delivery times stated on the website. Should the ordered goods not be deliverable within these times, Vice Golf will inform you immediately. In this case, the customer may choose to wait for the ordered goods or withdraw from the contract after setting a reasonable grace period. The obligation to set a grace period does not apply if it is unreasonable for the customer, especially in the case of fixed-date transactions or if the interest in setting a grace period ceases for compelling legal reasons.

In the event of impossibility of delivery or delivery disruptions not within Vice Golf's control (e.g., due to force majeure) and not caused by Vice Golf's fault, both parties are entitled to withdraw from the contract. In the event of withdrawal, any payments already made will be refunded promptly.

Orders and other services from Vice Golf are only fulfilled if there are no outstanding payments from other contracts with the customer. Customer payments are offset against outstanding claims and interest in the order of their respective due dates.

Shipping Costs:

  • Within Germany: EUR 5.99 per order

  • Within the EU (excluding Germany and Sweden): EUR 7.99 per order

  • Within Sweden: SEK 79.00 per order

  • Within Switzerland: CHF 8.99 per order

  • Within the United Kingdom: GBP 4.99 per order

  • Within Australia: AUD 7.90 per order

  • Other countries via www.vicegolf.com/de: EUR 49.99 per order

For shipping, Vice Golf forwards the customer's postal and email address to our shipping service provider for the purpose of delivery and shipment notification. This is based on §5 PDSV and §28(1) BDSG as part of the shipping contract between Vice Golf and the shipping provider. No customer consent is required for this. The shipping provider processes this data exclusively for the stated purpose. Data is collected shipment-related and stored in our databases for legal archiving periods, e.g., for complaints and billing purposes. Customers can request their email address to be blocked for shipment notifications via the shipping provider.
